A non-refundable deposit in the amount of fifty percent (50%) of the total cost of the photo booth booking is due upon signing of this contract and booking the event with Provider. The remaining Balance is due 30 days prior to event! Client agrees that in addition to any and all other legal rights and remedies Provider may have, Client will pay a fifty dollar ($50) fee for any and all returned checks or charges from Client’s banking institution as payment for any service by Provider or rental of Provider’s equipment. Client hereby agrees and understands that all sales are final with Provider’s services.
SETUP OF SERVICES
Provider agrees to have photo booth operational for a minimum of 80% of the time during this period; occasionally, operations may need to be interrupted for maintenance of photo booth. Client agrees to allow for one (1) hour prior to event for set up and one (1) hour after the event for break down. Events located outside of 60 miles from the photo booth office, will be charged an additional $150 per hour for additional drive time to, and from the event.
ACCESS, SPACE, AND POWER FOR BOOTH
Client agrees to arrange for an appropriate space for the photo booth at the event venue. Client is responsible for providing power for the photo booth. The photo booth requires a 110V, 10 amps, three (3) prong outlet from a reliable power source within fifty (50) feet of the set-up area, not to be in the way of any walkways. The circuit must be free of all other connected loads. Any delay in the performance or damage to the photo booth equipment due to improper power is the sole responsibility of Client. Client shall provide crowd control if warranted, and furnish Provider with directions to the event. Client shall also furnish Provider with safe and appropriate working conditions with a solid floor space free from potential risks of damage to the equipment. This includes at least a ten (10) foot by ten (10) foot space, with at least eight (8) foot ceilings.
DATE CHANGES AND CANCELLATIONS
Any request for a date change must be made in writing at least thirty (30) days in advance of the original event date. Change is subject to photo booth availability and receipt of a new Rental Agreement. If there is no availability for the alternate date, the deposit shall be forfeited, and event cancelled. Any cancellation occurring less than thirty (30) days prior to the event date shall forfeit all payments received for photo booth rental.
EVENTS BEYOND OUR CONTROL
Mirror Mirror cannot be held responsible for any circumstances that may prevent us from attending your event; these may include but are not limited to, severe weather conditions, traffic delays, breakdown of our vehicles, sickness or equipment failure. In the case that we cannot attend or fulfill your hire due to events beyond our control we will contact you or the venue as soon as possible. In these instances our liability will be limited to the refunding all of monies paid.
DAMAGE TO PROVIDERS EQUIPMENT AND SERVICE REFUSAL
Client acknowledges that Client is solely responsible for any damages or loss to the Provider’s equipment caused by conditions such as, but not limited to; A) Any misuse of the Provider’s equipment by Client or Client’s guests (invited or uninvited), B) Any theft that occurs of Provider’s equipment during the Service Period, or C) Any damage caused by Disaster (including but not limited to fire, flood, earthquake, or vandalism). Client acknowledges that Provider shall have the right to decline service to Client’s guests (invited or uninvited), for misuse, inappropriate photos, unruly behavior, or any other occurrence in which Provider feels it best for safeguarding of the equipment.
Client agrees to, and understands the following terms of indemnification: A) Client will indemnify Provider against any and all liability related to Client’s Event, before, during, and after Client’s Event. Client will indemnify Provider from the time of execution of this agreement, indefinitely, against any liability associated with Client. B) Client will indemnify Provider against any and all liability associated with the use of pictures taken within the Provider’s equipment, employees, or affiliates at Client’s event. C) Client agrees to indemnify Provider against any liability associated with the Client’s venue. D) Furthermore, Client agrees to hold harmless Provider for any and all claims of liability or potential law suit or claims.
Client agrees to, and understands the following: All guests using the photo booth hereby give Provider the right and permission to copyright and use, photographic portraits or pictures of any photo booth user who may be included intact or in part, made through any and all media now or hereafter known for illustration, art, promotion, advertising, trade, or any other purpose. In addition, Client hereby releases, discharges, and agrees to Provider, from any liability that may or may not occur or be produced in the taking of said pictures or in any subsequent processing thereof, as well as any publication thereof, including but not limited to any claims of libel, slander, or invasion of privacy.
NO LIABILITY IS ACCEPTED FOR:
1. Loss of or damage to property belonging to or travelling with the members of any group. For example watches, jewelery, cameras or clothing.
2. Personal injury or death of any participants however caused unless by proven negligence of Mirror Mirror.
